1 – Purpose of Policy

  • 1.1 Your privacy in using this site (the “Site”) or the AllCrew app (the “App”) is a top priority of Wingman Australia Pty Ltd t/as AllCrew International (“AllCrew”, “we”, “us” or “our”) as it is important to us that you can trust the Site and the App to connect with other users of the Site and the App.
  • 1.2 We design all of our products and services with your privacy in mind and have written this Privacy Policy in plain language to ensure that you can read and understand it.
  • 1.3 We have adopted this Privacy Policy to ensure that we have standards to protect the Personal Information that we collect from users of the Site and the App (“Users”) and individuals who register themselves as members of the Site and the App (“Members”) as part of the conduct of the Site and the App (specifically) and our business (generally).
  • 1.4 This Privacy Policy follows the standards of the Australian Privacy Principles set by the Australian Government for the handling of Personal Information under the Privacy Act 1988 (Cth) (“Privacy Act”).

2 – Who and What This Policy Applies To

  • 2.1 Our Privacy Policy deals with how we handle “personal information” (as it is defined in the Privacy Act (“Personal Information”)) that we collect from you or in relation to you.
  • 2.2 We handle Personal Information for our own purposes, and also for and on behalf of Users and Members.
  • 2.3 This Privacy Policy applies to all forms of information, physical and digital, whether it is collected or stored electronically or in hardcopy.
  • 2.4 If, at any time, you provide Personal Information or other information about someone other than yourself, you warrant that you have that person’s consent to provide such information for the purpose specified.

3 – The Personal Information We Collect From You

  • 3.1 In the course of operating our business, the Site and the App, we collect Personal Information from you that:
    • (a) allows us to identify who you are as User or Member for the purposes of operating and maintaining our business, the Site and the App;
    • (b) enables us to contact and/or transact with you so that you can most effectively use the Site and the App;
    • (c) enables you to share Personal Information with Users and/or Members so that you can most effectively use the Site and the App by, among other things, organising or attending events with other Users or Members (“Events”).

    • (a) personal details such as your name, location, date of birth, and other information defined as “Personal Information” in the Privacy Act that allows us to identify who the individual is;
    • (b) information such as your email address, telephone number, residential address, and other information that allows us to contact you;
    • (c) information such as the Events you attend or promotions and events that you may participate in through the Site and/or the App;
    • (d) your financial information such as any bank or credit card details that you use to transact with us and for us to provide you with access to the services that are offered by the Site and the App;
    • (e) chats and other communications that you may have with Users and/or Members on the Site and the App.
  • 3.3 We may collect the following information about you from other parties:
    • (a) information from Users or Members about Events that you attend;
    • (b) information that you share with us through your social media account;
    • (c) information from our business partners where, for example, you participate in jointly run promotions and campaigns.
  • 3.4 We may collect the following information about you that is generated when you use the Site or the App or our services:
    • (a) data relating to your usage of the Site and/or the App (eg: when you logged in, what parts of the Site and/or the App you accessed);
    • (b) information from and about the devices you use to access the Site, the App and/or our services (eg: device ID and type, software information such as IP address, apps settings, identifiers associated with cookies (see our Cookies Policy) or other technologies that may uniquely identify a device or browser); and
    • (c) with your permission, information on your precise geolocation.

4 – How We Use Personal Information

  • 4.1 We use the Personal Information we collect from you primarily to deliver and improve the services we provide and to make your use of the Site and/or the App as meaningful as possible.
  • 4.2 In particular, we may use the Personal Information we collect from you to:
    • (a) create and manage your Member account;
    • (b) provide you with customer support and respond to your requests;
    • (c) complete any transactions that you may enter into on the Site;
    • (d) communicate with you about our services, the Site and the App;
    • (e) connect you with other Users and Members to, among other things, facilitate Events;
    • (f) show you content to watch;
    • (g) review and understand your use of our services, the Site and the App to improve those services and, the Site and the App, and to develop new features and services;
    • (h) communicate with you by email, phone, social media or mobile device about products or services that we think may interest you;
    • (i) where necessary, find and address ongoing, suspected or alleged violations of our Terms of Use, particularly through the review of reports and interactions between Users and Members;
    • (j) design countermeasures against violations of our Terms of Use to prevent recurrences of those violations.
  • 4.3 We will not use any Personal Information that you provide to us other than for the purpose for which it was collected.
  • 4.4 We will retain Personal Information only as long as necessary.
  • 4.5 If we are required to disclose your Personal Information to a third party, we will do so in accordance with the Australian Privacy Principles, and we will inform you that we intend to do so, or have done so, as soon as practical.
  • 4.6 We will not disclose or sell your Personal Information to unrelated third parties except:
    • (a) where we reasonably believe that an individual may be engaged in fraudulent, deceptive or unlawful activity that a governmental authority should be made aware of; and/or
    • (b) as required by any law (including the Privacy Act); and/or
    • (c) in order to sell our business (in that we may need to transfer Personal Information to a new owner).
  • 4.7 We will not disclose your Personal Information to any entity outside of Australia that is in a jurisdiction that does not have a similar regime to the Australian Privacy Principles or an implemented and enforceable privacy policy similar to this Privacy Policy.

5 – Opting “In” or “Out”

  • 5.1 You may opt to not have us collect your Personal Information, and this may prevent us from offering you some or all of our services and may terminate your access to some or all of the services you access with or through us, the Site and the App.
  • 5.2 If you believe that you have received information from us that you did not opt in or out to receive, you should contact us on the details below.

6 – The Safety And Security of Personal Information

  • 6.1 We will take all reasonable precautions to protect your Personal Information from unauthorised access, and this includes appropriately securing our physical facilities and electronic networks.
  • 6.2 We cannot guarantee the security of online transactions and the security of communications sent by electronic means or by post, and you provide information to us via the internet or by post at your own risk.
  • 6.3 We cannot accept responsibility for misuse or loss of, or unauthorised access to, Personal Information where the security of that information is not within our control.
  • 6.4 We are not responsible for the privacy or security practices of any third party (including third parties that we are permitted to disclose an individual’s Personal Information to in accordance with this policy or any applicable laws), and the collection and use of an individual’s information by such third parties may be subject to separate privacy and security policies.
  • 6.5 If you suspect any misuse or loss of, or unauthorised access to, your Personal Information, you should let us know immediately.
  • 6.6 We are not liable for any loss, damage or claim arising out of another person’s use of the Personal Information where we were authorised to provide that person with the Personal Information.

7 – The Safety And Security of Personal Information

  • 7.1 Subject to the Australian Privacy Principles, you have the right to request from us the Personal Information that we have about you, and we have an obligation to provide you with such information within 28 days of receiving your written request.
  • 7.2 If you cannot update your own information, we will correct any errors in the Personal Information we hold about you within 7 days of receiving written notice from you about those errors.
  • 7.3 It is your responsibility to provide us with accurate and truthful Personal Information, and we cannot be liable for any information that is provided to us that is incorrect.

8 – Complaints And Disputes

  • 8.1 If you have a complaint about our handling of their Personal Information, you should address your complaint in writing to the details below.
  • 8.2 If there is a dispute regarding your Personal Information, we both must first attempt to resolve the issue directly between us.
  • 8.3 If we become aware of any unauthorised access to your Personal Information, we will inform you at the earliest practical opportunity once we have established what was accessed and how it was accessed.

  • 9.1 From time to time, we may send you important notices, such as changes to our terms, conditions and policies, and because this information is important to your interaction with us, you may not opt out of receiving these communications.
